Terms of Service

These Terms govern your use of Brunches Cafe's website, mobile experience, and ordering service (the "Service"). By placing an order or creating an account, you agree to these Terms. If you do not agree, please do not use the Service.
1. Who we are
Brunches Cafe operates from PSSDC Road, Encounter House, Magodo, Lagos. You can reach us at hello@brunchescafe.ng or +234 913 500 1162.
2. Eligibility
You must be at least 18 years old, or have the consent of a parent or guardian, to place an order. By placing an order you confirm that the information you provide is accurate.
3. Orders and acceptance
Submitting an order is an offer to buy. No contract is formed until we confirm acceptance and payment is successful. We may decline an order, in whole or in part, if an item is unavailable, the delivery address is outside our service area, or if we suspect fraud.
4. Pricing and payment
- All prices are in Nigerian Naira (₦) and include applicable VAT where stated.
- Delivery fees, where applicable, are shown at checkout.
- Payment is processed securely by Paystack. We never see or store your card details.
- Orders are not confirmed until payment is successful.
5. Delivery and pickup
We aim to prepare and deliver orders within the estimated time shown at checkout, but delivery times depend on traffic, weather, and order volume. Risk in the goods passes to you on delivery or pickup. If you are not available to receive a delivery, our rider will attempt one re-delivery; further attempts may incur an additional fee.
6. Cancellations and refunds
- Because food is prepared fresh on demand, an order can only be cancelled while its status is "received" or "preparing". Once it is "ready" or "out for delivery", it can no longer be cancelled.
- If we cancel an order, you will receive a full refund within 7–14 business days via your original payment method.
- If an item arrives damaged or significantly different from what was ordered, contact us within 2 hours of delivery with photos and we will refund or replace it.
- We do not refund for change of mind once food has been delivered.
7. Food safety and allergens
Our kitchen handles common allergens including wheat, eggs, dairy, peanuts, tree nuts, soy, sesame, fish, and shellfish. While we take care to prevent cross-contact, we cannot guarantee any item is allergen-free. If you have a severe allergy, please tell us before ordering. Our kitchen practices comply with NAFDAC guidelines and the FCCPA 2018.
8. Consumer rights (FCCPA 2018)
Nothing in these Terms excludes or limits the statutory rights you have as a consumer under the Federal Competition and Consumer Protection Act (FCCPA) 2018, including your right to goods that match their description and are of merchantable quality.
9. Loyalty programme
Loyalty points are awarded on completed orders and have no cash value. We may adjust the earn rate, redemption rules, or expire points with reasonable notice. Points obtained fraudulently will be cancelled.
10. Accounts
You are responsible for keeping your account credentials secure and for activity on your account. Notify us immediately of any unauthorised use. We may suspend or close an account that breaches these Terms.
11. Intellectual property
All content on the Service — logos, names, photography, recipes, copy — is owned by Brunches Cafe or its licensors and is protected by Nigerian and international copyright and trademark law. You may not reproduce, distribute, or use any of it commercially without our written permission.
12. Limitation of liability
To the maximum extent allowed by Nigerian law, our total liability for any claim arising out of or in connection with the Service is limited to the amount you paid for the affected order. We are not liable for indirect or consequential loss. Nothing in this clause limits liability for death, personal injury caused by our negligence, fraud, or any other liability that cannot lawfully be excluded.
13. Privacy
Your use of the Service is also governed by our Privacy Policy, which forms part of these Terms.
14. Governing law and disputes
These Terms are governed by the laws of the Federal Republic of Nigeria. Any dispute will be resolved first by good-faith discussion, then by mediation, and failing that by the competent courts of Lagos State.
15. Changes to these Terms
We may update these Terms from time to time. Material changes will be posted on this page with a revised date. Continued use of the Service after an update constitutes acceptance.
